Welcome to Starling Floral ("we", "us", or "our"). These Terms & Conditions ("Terms") govern your access to and use of our website, services, and products offered through www.starlingfloral.ca (the "Site"). By placing an order or using our services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use our Site or services.
1. General Information
Starling Floral is a floral e-commerce business operating out of Toronto, Ontario, Canada. We specialize in the design, sale, and delivery of custom seasonal floral arrangements using 100% Ontario-grown flowers. Our arrangements reflect the natural beauty and rhythm of the local growing season.
2. Orders
All orders placed through our Site are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including due to pricing errors, suspected fraud, or unavailability of products.
While we do not offer a standing subscription service, we may accept recurring orders on a case-by-case basis, which will be invoiced or processed manually.
For custom orders, including but not limited to small events, bespoke floral arrangements, and bulk flower purchases, specific terms and conditions will be agreed upon between Starling Floral and the customer at the time of order confirmation. Custom orders will be invoiced separately and may require a deposit or full payment in advance, as outlined in the individual agreement. All details such as pricing, delivery dates, floral selections, and any additional services will be specified in the custom order agreement. Once the agreement is confirmed by both parties, it is considered binding. Custom orders are non-refundable and cannot be changed once materials have been sourced or work has commenced, unless otherwise agreed in writing. Unless otherwise specified, payment for custom orders is due within thirty (30) calendar days from the date of the invoice.
Adverse Weather and Crop Loss
Because we use 100% Ontario-grown flowers, our supply is subject to seasonal and environmental factors. In the event of major adverse weather events or agricultural conditions—including but not limited to frost, flooding, tornadoes, or extreme drought—that result in widespread crop loss and make it impossible for us to fulfill orders using our standard locally sourced materials, we reserve the right to cancel affected orders at our sole discretion.
In such cases, customers will be notified as soon as possible and may be offered a full refund or the option to reschedule delivery, subject to availability.
Allergies and Toxicity
Please be aware that our flowers are either field-grown or foraged and may carry naturally occurring pollen, plant material, or other potential allergens. If you or your recipient have known sensitivities to flowers, plants, or pollen, we recommend exercising caution when handling or placing an order. Starling Floral is not responsible for any allergic reactions that may result from exposure to our floral arrangements or related products.
Additionally, some flowers and foliage used in our arrangements may be toxic to humans and pets if ingested. Particularly dangerous flowers include lilies, daffodils, tulips, foxglove, sweet peas and chrysanthemums, among others. It is the customer’s responsibility to ensure that all floral products are kept safely out of reach of children and animals. Starling Floral is not liable for any illness, injury, or adverse effects resulting from the ingestion or improper handling of our products.
By placing an order with us, you acknowledge and accept these risks and agree to take appropriate precautions. If you are unsure about potential sensitivities, please contact us prior to placing an order and we will do our best to advise.
3. Pricing and Payment
All prices are listed in Canadian Dollars (CAD) and are subject to applicable taxes. Prices may change at any time without notice. Payment must be received in full before your order is processed.
We accept all major credit cards and digital wallets, including Apple Pay, Google Pay, and Link by Stripe. Payments are securely processed through our third-party payment provider. We do not store or have access to your complete payment details
4. Delivery
We offer delivery to all “M6” Toronto postal codes: M6A, M6G, M6H, M6J, M6K, M6L, M6M, M6N, M6P, and M6R.
Deliveries are scheduled every Friday between 12:00 PM and 6:00 PM from early May to mid-October, unless otherwise noted on our Site. All deliveries are subject to our absolute discretion, and we may, from time to time, deliver outside the specified zones or schedule on a case-by-case basis. Delivery times may be affected by traffic, weather, or other unforeseen delays. We will make reasonable efforts to deliver within the stated window.
It is your responsibility to ensure that accurate delivery information is provided at checkout. We are not responsible for delivery failures due to incorrect or incomplete addresses.
Additional delivery fees may apply and will be disclosed at checkout.
5. Returns & Refunds
We strive to deliver the freshest possible product. In the rare case that an arrangement arrives damaged during transit or appears not fresh, customers must notify us by email within 24 hours of delivery.
Claims must include:
A brief description of the issue
At least one photo of the arrangement
If the flowers do not meet our quality standards, we will offer either:
A replacement arrangement on the next available delivery date;
A store credit for the full value of the arrangement; or
A full refund
Refunded transactions will typically be returned to your account within 2–7 business days, depending on the card issuer. Store credits will be issued in the form of a digital gift card unless otherwise agreed.
If damage or a lack of freshness is due to the recipient not being home at the time of delivery, we cannot guarantee the condition of the flowers upon retrieval and we are not liable for product degradation caused by delayed collection.
In the event of non-delivery due to factors outside our control—including but not limited to lack of access to residential or commercial buildings (e.g., locked lobbies or concierge-only entry)—we may attempt one re-delivery. Otherwise, the flowers will be returned to our studio and sent out again the following day, subject to a $12 redelivery fee (exclusive of HST). This fee will be collected via invoice prior to re-delivery.
Due to the perishable nature of floral products, we do not offer returns or refunds for any other reasons.
6. Order Changes
For changes to your order such as the delivery details or message card, please email hello@starlingfloral.ca prior to 9:00 AM on the scheduled delivery day. We will make reasonable efforts to accommodate your requests.
7. Cancellations
Cancellations are accepted if received no later than 5 days prior to the selected delivery date, and in such cases, a full refund will be issued.
If cancellation is requested with less than 5 days’ notice, but we have not begun to design or prepare the order, you will receive a store credit for the full value of your order. This credit expires at the end of the next Ontario growing season, so credit issued in summer 2025 would expire October 31, 2026. If we have already begun preparation of your order, no refund or store credit will be provided. Store credits will be issued in the form of a digital gift card unless otherwise agreed.
8. Offers and Promotions
From time to time, at our sole discretion, we may offer discounts, promotions, or special offers on floral products. The price at the time of order shall prevail.
We reserve the right to modify or withdraw any offers or promotions at any time without prior notice. Additionally, discounts or special pricing may be offered to individual customers at our discretion and are not guaranteed.
9. Product Substitution
Due to the nature of using hyper-seasonal, locally sourced product, the arrangement you receive will not look identical to the photos on the website. We reserve the right to use whatever flowers and materials we choose, subject to seasonal and grower-specific availability.
We do not accommodate specific colour or flower requests.
10. Use of Personal Information
Your submission of personal information through the Site is governed by our Privacy Policy.
We do not sell or rent your personal information to third parties. All data is used strictly for order processing, communication, and to improve our service offerings.
11. Intellectual Property
All content on the Site—including images, text, logos, and designs—is the exclusive property of Starling Floral and is protected by Canadian and international copyright, trademark, and other intellectual property laws.
No part of the Site’s content may be copied, reproduced, distributed, transmitted, displayed, published, or broadcast without the prior written consent of Starling Floral, except where expressly permitted by law.
12. Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Starling Floral, its affiliates, directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:
Your access to or use of, or inability to access or use, the Site or services;
Any conduct or content of any third party on the Site;
Any content obtained from the Site; or
Unauthorized access, use, or alteration of your transmissions or content.
13. Governing Law and Jurisdiction
These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to any conflict of laws principles.
You agree that any legal action or proceeding arising under or relating to these Terms shall be brought exclusively in the courts located in Toronto, Ontario, and you hereby consent to the personal jurisdiction and venue of these courts.
n the event of a dispute, the parties agree to make reasonable efforts to resolve the matter through informal negotiation before initiating formal legal proceedings.
14. Force Majeure
We shall not be liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, government restrictions, pandemics, labour strikes, transportation delays, or supply chain disruptions. In such cases, we will make reasonable efforts to notify affected customers and propose an alternative solution where possible.
